This Privacy Policy details how Central Negros Electric Cooperative, Inc. (CENECO) collects and processes personal information and sensitive personal information in compliance with the Republic Act 10173 (Data Privacy Act of 2012), and its implementing rules and regulations. CENECO is committed to ensuring that the processing of personal information adheres to the principles of transparency, legitimate purpose, and proportionality.

 

WHAT WE COLLECT

A. From existing and prospective consumers either with connected, disconnected or terminated services:

  1. Information you provide to us when you apply for service, such as your name, address, telephone/cellphone number, email address, details on your government issued IDs, evidence of occupancy (e.g., Transfer Certificate of Title, Special Power of Attorney (SPA), Undertaking/ Authorization from owner of the premises) and details of your authorized representative, if any;
  2. Information to determine eligibility to participate in certain energy programs or services, such as net metering, Green Energy Option Program (GEOP), etc.
  3. Information provided when reporting your concerns/inquiries/complaints or posting your comments or statements either through the website, social media account, email, text message or telephone/cellular phone calls or letters (snail mails or directly forwarded to our office);
  4. Information logged when accessing our website and applications, such as your IP address, the date and time you visited the site, geolocation.
  5. Information provided when registering to short message service (SMS) for billing inquiries and other services.
  6. Information provided for verification purposes such as when claiming for an official receipt, personally lodging a complaint at the collection/disconnection section;
  7. Responses you or your representative provide when you participate in our consumer satisfaction surveys;
  8. Information you provide when enrolling your checking accounts used for payment of electric bills and/or other accounts such as bank account name and account number
  9. Information you provide to facilitate requests for refund (line extension, bill, and meter deposit), for overpayment or double payment of bills, and for availment of zero-rated Value-Added Tax such as photocopy of a valid / government-issued identification card and PEZA certificate;
  10. CCTV footage and other images captured or recorded through electronic means or processes; and
  11. Any other information you voluntarily provide for any legitimate purpose declared at point of collection of such information.

B. From prospective, active and separated employees:

  1. Information you submit when applying for work at CENECO, including but not limited to curriculum vitae, bio data, transcript of records, and NSO/PSO copy of birth certificate. This also includes information from third persons submitted as character references.
  2. Information needed during the processing of your application, such as testing (logical and psychological) results, results of character investigation, and doctor’s certifications, police, fiscal, NBI and barangay clearances;
  3. Information we collect and maintain about you during and after your employment, such as all payroll information, wages, benefits, taxes, bank account information, health and welfare benefits including information of beneficiaries, medical, laboratory and dental records, emergency contact information, performance evaluations, certifications (e.g. lineman’s training certification, attendance to seminars and conferences), notices to explain sanctions, and change of appointments including promotions.
  4. Information that we may gather from third persons for purposes not stated above such as those necessary for ongoing investigations (administrative or otherwise) or audits (internal or external) (e.g., police blotters, court records, third person testimonies, entrance logbooks from third party establishments or firms, attendance records to third party events).
  5. Information that may be required by banks for the processing of authority to sign checks and bank forms in behalf of CENECO.
  6. CCTV footage and other images captured or recorded through electronic means or processes; and
  7. Any other information you voluntarily provide for any legitimate purpose declared at point of collection of such information.

C. From prospective and existing vendors, suppliers or contractors:

  1. Information you submit to CENECO for accreditation, participation in the public bidding, processing of payments such as company/proprietor name, tax identification number, business permits, financial statements, certifications from third parties, and contact details;
  2. Information you submit to prove exemption from income tax such as BIR rulings or PEZA certificate;
  3. Information you provide to facilitate online fund transfer of payments made to you by CENECO such as bank account name and bank account number.
  4. CCTV footage and other images captured or recorded through electronic means or processes; and
  5. Any other information you voluntarily provide for any legitimate purpose declared at point of collection of such information.

D. From prospective or existing Board of Directors:

  1. The information you submit to us when you apply to become a Board of Director or in the course of being a Board of Director of CENECO like your name, address, contact details, marital status, government issued IDs, employment history, educational backgrounds, and if applicable, details of your authorized representative;
  2. The information you submit to us which we submit in compliance with bank requirements and when processing your authority to sign checks, if applicable, like your SSS/GSIS membership number;
  3. Information that we may gather from third persons for purposes not stated above such as those necessary for ongoing investigations (administrative or otherwise) or audits (internal or external) (e.g., police blotters, court records, third person testimonies, entrance logbooks from third party establishments or firms, attendance records to third party events).
  4. CCTV footage and other images captured or recorded through electronic means or processes; and
  5. Any other information you voluntarily provide for any legitimate purpose declared at point of collection of such information.

E. From guests / visitors:

  1. The information you provide when you enter our premises such as your name, address, purpose of visit, contact number;
  2. CCTV footage and other images captured or recorded through electronic means or processes; and
  3. Any other information you voluntarily provide for any legitimate purpose declared at point of collection of such information.

 

WHAT WE DO WITH THE INFORMATION WE GATHER

 

CENECO stores, processes, and analyzes the information that you provide to us for purposes, including but not limited to: A. From existing and prospective consumers either with connected, disconnected or terminated services:

  1. Providing you with electric services and managing your account;
  2. Continuously improving our electric services;
  3. Responding promptly to your concerns, inquiries and complaints;
  4. Providing our third party partners (e.g., collection centers, collecting agents) with your CENECO account information for online viewing of your account;
  5. Verifying your identity when you access your account through the various customer engagement channels (e.g., e-mail, website, mobile application, via phone call, walk-in);
  6. Sending you information on matters involving your account or the activities of the Cooperative;
  7. Verifying your identity and eligibility to claim refunds;
  8. Verifying and keeping a record of the details of the checking account/s you use in the payment of your electric bills and/or other accounts;
  9. Protecting your safety and legal rights, as well as those of others; and
  10. Complying with applicable legal and statutory requirements such as court orders and government regulations.

B. For our prospective, active and separated employees

  1. Evaluating your eligibility for employment, including the verification of your qualifications and character references (character investigation);
  2. Evaluating your performance for rewards and promotions;
  3. Investigating and issuing disciplinary sanctions;
  4. Collecting and maintaining contact information;
  5. Maintaining your employment records;
  6. Processing employee work-related claims (e.g. worker compensation, insurance claims, etc.);
  7. Complying with bank requirements as to authorized bank signatories;
  8. Protecting your safety and legal rights, as well as those of others; and
  9. Complying with applicable legal and statutory requirements such as court orders and government regulations.

C. For our Vendors, Suppliers or Contractors

  1. Verifying the authenticity of your submitted documents for accreditation and eligibility to participate in the public bidding;
  2. Conducting and maintaining business relationships with you;
  3. Processing of payments;
  4. Protecting your safety and legal rights, as well as those of others; and
  5. Complying with applicable legal and statutory requirements such as court orders and government regulations.

D. For our Board of Directors

  1. Maintaining your personal records;
  2. Facilitating communications with you, including responding to your queries and requests, sending notices of general meetings, annual reports and shareholder circulars to you;
  3. Complying with bank requirements for authorized bank signatories, and to submit details for the bank’s records of CENECO’s officers and directors;
  4. Protecting your safety and legal rights, as well as those of others; and
  5. Complying with applicable legal and statutory requirements such as court orders and government regulations.

E. For our visitors / guests

  1. Establishing your identity;
  2. Recording the purpose of your visit;
  3. Protecting your safety and legal rights, as well as those of others; and

HOW WE PROTECT YOUR PERSONAL INFORMATION

 

The integrity, confidentiality and security of your personal information is important to us. CENECO respects your right to privacy and shall treat your personal information as confidential. As we respect your privacy, we will only use your personal information for the purposes above stated when you are aware thereof. To protect your personal information, CENECO has the following in place:

  1. A secured server with firewall, encryption and security controls;
  2. Restriction of access to these information only to our qualified and authorized personnel;
  3. Data sharing agreements, which require compliance with the Data Privacy Law, with third party partners;
  4. Storage of information for as long as it is necessary:
    • for the fulfillment of the declared, specified, and legitimate purposes provided above, or when the processing relevant to the purpose has been completed or terminated;
    • for the establishment, exercise or defense of legal claims; or
    • for other business purposes, that are consistent with standards established or approved by regulatory agencies governing CENECO;

 

DATA DISCLOSURE AND SHARING WITH THIRD PARTIES

 

Personal information gathered by CENECO for the purposes stated above shall be restricted to authorized CENECO employees and contractors only. Contractors are required to sign a Data Sharing Agreement to ensure that personal information we collect from you is secured, kept confidential, and protected from unauthorized disclosure or use for purposes other than those stated in the contract. CENECO may also disclose your information to government entities when so required by applicable laws, regulations, subpoena, or court orders.

CENECO shall judiciously place the necessary organizational, physical, and technical measures to ensure the security of your personal information upon collection, receipt, transmission, storage, and disposal. Your information may be transmitted back to you in the form of electric bills, notices of disconnection, written correspondences. Moreover, your information may be accessed via mobile phones, personal computers and laptops through services we make available through the internet (e.g., website, mobile application). You are responsible for the security of such information when it reaches you or your representative. We recommend that you take appropriate measures to ensure that your information is not accessible to other persons without your permission. Moreover, we also recommend that you install the necessary protection in your devices such as anti-virus software and firewall for added safety.

 

PERSONAL INFORMATION AUTOMATICALLY OBTAINED FROM YOUR INTERACTIONS WITH OUR WEBSITE AND OFFICIAL MOBILE APPLICATIONS, AND LINKS TO OTHER WEBSITES
